MACP

Dear Members, We are contentiously fighting with administration for our demands. We are very much concern about the MACP scheme, the day from the 6th pay commission submitted the report. After that report the Association hold a Mass Rally at Jantar Mantar, The 1st ever rally hold by any organisation of CPWD. After the Cabinet approved the pay commission report and announces the three up gradation under MACP after 10,20 and 30 years, initially we were very happy because we have demanded Three up gradation in our memorandum submitted to pay commission. But this happiness lasted for few hours. After studying the pay commission report we found that they have given 3 up gradation as Grade Pay Hierarchy not the scale of AE,EE,SE as we thought and demanded. We try to unite all the Association to fight for hierarchy based MACP but both the other association give up fight by saying that this scheme is applicable for all central Govt. employees and it is very difficult to get it. We did not loose our hope and we approached the Secretary of JCM Shri Umraomal Purohit to raise the issue,JCM appreciated our efforts and they raised the issue in the National Anomaly Committee. We also approached so many M.P.,s and got letter in our favour and due to continuous pressure the DOPT agreed to provide Special Package for CPWD. The association hold G.B.M. on 15-11-2010 and change our demand on MACP as Two up gradation as promotion hierarchy and 3rd as Grade Pay hierarchy i.e. 7600.The proposal was sent to DOPT, but DOPT did not agree. After that individual option was also rejected.
Now a ray of hope has again came up. One Sh Raj Pal ,Photo Copier, CAT, Chandigarh has filed a suit in CAT, Chandigarh OA No 1038/CH/2010 to ask the Hon able CAT to intervene in MACP scheme and demanded hierarchy based MACP. The CAT has issued order on 31-05-20111 and directed his department to allow him hierarchy based MACP. The court in his judgement has specifically mention that the very purpose of ACP was to provide the employee the scale of next higher post because he is not getting the promotion benefit due to stagnation in cadre .The court has also mentioned that the only change in ACP & MACP scheme is that in MACP the next higher post Grade Pay will be Granted after 10,20,30 years instead of Two next higher post scale after 12 & 24 Years. The Hon'able High Court of Punjab-Haryana has also upheld the decision of CAT, Chandigarh on his order dated 19-10-2011 in CWP NO 19387 of 2011.Also Hon'able Supreme court of India has dismissed the SLP no 7467 of 2013 on 15-04-2013 in the same case, however it is our duty to tell all of you that this SLP has not been dismissed on merit but it has been dismissed due to time bar.
We approached one of ASG of India who is friend of our Chairman, Er. Karamvir Singh in this regard and he has advised us to file the suit in Chandigarh because the earlier case has also been decided by same court and also up heald by Chandigarh High Court Therefore the Association has decided in executive committee meeting to file a court case in CAT, Chandigarh and all the expenses for this will be born by the association from association fund. We have prepared all the document for case and will file the case in CAT, Chandigarh shortly. All are requested not to waste their hard earned money if somebody asked u the money for filing the case. We are hopeful to get Rs 6600 & Rs 8700 as 2nd and 3rd up gradation. I will inform you after the case is filed.

  7. 7th CPC has submitted the report. Nothing has been gained in MACP. There is only a hope in Apex Court case .therefore I am of the view that all our cadre well wishers should fight the case wilh full efforts & unitedly. Pl. do the needful in this matter so that the case can be fight with full efforts.
